definitely, it is animal cruelty. Those people are not properly taking care of there dog they should have to take responsibility for there actions.

Yes. The opposite extreme is to have a dog that is emaciated and that is considered neglectful. Why shouldn't obesity be considered neglectful? It makes me crazy when people don't understand why their dog is so fat... Stop feeding it and take it for a walk!!

Its neglect, yes, because they have neglected to have the dog see a vet to see if there is a reason for the obesity (aside from overfeeding!), and what they can do about it.
Its cruelty as well. An obese dog is not living a full life, an obese dog can't function properly (organ-wise), and is extremely unhealthy. Overfeeding lessens the dogs lifestyle, so yes, its cruel.
The owner should always be held accountable in any shape of neglect or cruelty, regardless of the issue. Be it a completely emaciated animal, or a 40 pound beagle.
